Please apply with CV in Word Format Only. ABOUT THE ROLE The successful appointee will undertake complex legal matters handled by Senior Lawyers within the department. The legal work handled within the Native Title Claims and Agreements team includes: Litigation, mediation and negotiation in relation to native title determination applications filed in the Federal Court.
Provide advice in the context of native title determination applications on matters including: - Whether connection and evidentiary material satisfies the requirements of the Native Title Act 1993; - Statutory interpretation in particular the Native Title Act 1993 (Cth), Aboriginal Land Act 1991 and the Nature Conservation Act 1992; - Risks and consequences of Government adopting policy positions; and - Future Act processes under the Native Title Act 1993 (Cth) Negotiate, draft, review and advise complex agreements (such as Indigenous Land Use Agreements); having regard to relevant legislation including the Land Act 1994 , Aboriginal Land Act 1991 and the Nature Conservation Act 1992. Your key responsibilities Conduct a professional legal practice as a specialist practitioner and undertake the range of legal work set out in the attached Schedule, in respect of the areas of law identified.
When required provide supervision and guidance to other members of the practice in conduct of legal matters. As required, assist in: The provision of legal training to officers of client Departments; The provision of specialist advice and guidance on questions of law and practice to other officers within the Legal Practice Group; Liaising with officers of Government Departments, Corporations and Instrumentalities; Negotiate skilfully in tough situations, winning concessions without damaging relationships; and Write and communicate clearly, succinctly in a variety of settings to convey messages that will achieve a desired effect. ABOUT YOU The Ideal candidate will be someone who has: Demonstrated experience working with Native Title policies and procedures.
Admission, or eligibility for immediate admission, as a Legal Practitioner of the Supreme Court of Queensland, and enrolment or eligibility for enrolment, to practice in the Federal and High Courts of Australia. It will be a condition of appointment that the successful appointee be admitted as a Legal Practitioner of the Supreme Court of Queensland at least on a conditional basis within 3 months of the date of appointment.
